4 Text Messaging (SMS) Privacy Disclosures — “Scale”
Monarch may send text messages under the Scale program for account alerts/updates and reminders and marketing, depending on what you opt into. SMS may be delivered using providers such as Twilio, Telnyx, and platforms that facilitate messaging (including GoHighLevel, where used). We may send SMS internationally where supported and permitted by law.
A. Consent / Opt-In
You will only receive SMS messages if you provide consent through one of the following:
- a web form checkbox,
- a keyword-based opt-in, and/or
- an in-app toggle/setting.
We may use a double opt-in process (for example: after you opt in, you receive an initial message asking you to confirm).
B. Opt-Out
You can opt out at any time by replying STOP. After you opt out, you may receive a final confirmation message and then no further messages unless you re-opt in.

F. SMS Opt-In Data
Text messaging opt-in data and consent will not be sold or shared with third parties for their marketing or promotional purposes. We may share information with service providers that help us deliver messages and operate the Services.

Use the following language next to the SMS opt-in checkbox (and similarly for in-app toggles):

For keyword-based opt-in, display the same disclosures at the point where the keyword is presented and/or where the phone number is collected, and include opt-out/help instructions in the initial messages.
5 How We Share Information
We may share personal information in the following circumstances:
A. Service Providers
We share information with vendors and service providers that help us operate the Services and perform business functions on our behalf, such as hosting, analytics, customer support tools, email and SMS delivery, fraud prevention, and payment processing. These providers may process personal information only to provide services to us.
B. Referral/Attribution and Accounting — Monarch Labs Joint Venture Program
If you were referred to us through the Monarch Labs Joint Venture Program, we may share limited information necessary to attribute the referral and reconcile accounting, such as confirmation that a sale occurred and basic attribution details. We do not share SMS opt-in consent with partners for their marketing purposes.
C. Legal and Safety
We may disclose information to comply with applicable law, respond to lawful requests, protect rights and safety, investigate suspected fraud or security issues, and enforce our terms.
D. Business Transfers
If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be transferred as part of that transaction.
6 Business Customers and Data Processing (Controller/Processor)
Many of our customers use the Services for business purposes. Depending on how a business customer uses the Services:
- Monarch as Controller: We act as a controller for personal information we collect and process for our own purposes (for example, operating our websites, managing our customer relationships, billing, marketing, and improving our Services).
- Monarch as Processor/Service Provider: When a business customer uploads, stores, or otherwise submits personal information into the Services as part of their use of the Services (for example, contact records, messages, scheduling data, or CRM-related data), Monarch may process that information on the customer’s behalf under the customer’s instructions. In those cases, the business customer is typically the controller (or “business”) and Monarch is the processor (or “service provider”).
If you interact with a business customer using our Services and want to exercise rights relating to data the business customer controls, you should contact that business customer directly. Monarch will support our business customers in responding to such requests as required by applicable law.

7 International Transfers
The Services are operated from the United States, and we may process and store information in the United States and other countries where we or our service providers operate. If you access the Services from outside the United States, you understand that your information may be transferred internationally.
8 Data Retention
We retain personal information for as long as reasonably necessary to provide the Services and for legitimate business purposes, including security, fraud prevention, compliance, and dispute resolution.
Unless a longer period is required by law or necessary for legitimate business purposes:
- We generally retain certain account logs and marketing list records for up to 30 days.
- We retain account and customer relationship records while an account is active and for a reasonable period afterward as needed for operations, compliance, and dispute resolution.
Deletion requests: You may request deletion by emailing [email protected]. We aim to complete verified deletion requests within 48 hours where feasible, subject to legal, security, fraud-prevention, and operational requirements.

We use reasonable administrative, technical, and organizational measures designed to protect personal information. No security measures are perfect, and we cannot guarantee absolute security.

The Services are not directed to children under 13. If you are under 13, do not use the Services or provide personal information.
