This Acceptable Use Policy (“AUP”) governs your use of the websites, software, applications, and related services (collectively, the “Services”) provided by Monarch Labs, LLC (“Monarch,” “we,” “us,” or “our”), including Scale.GG, ScalePlus.GG, and all other Monarch Labs, LLC products, software, and websites.
This AUP is part of and incorporated into our Terms of Service. By using the Services, you agree to comply with this AUP. Violation of this AUP may result in suspension or termination of your account and access to the Services.
1 Prohibited Content
You may not use the Services to create, store, transmit, distribute, or promote any of the following content:
A. Illegal Content
- Content that violates any applicable local, state, national, or international law or regulation
- Content that promotes, facilitates, or instructs illegal activity
- Content involving the sale or distribution of illegal substances, controlled substances, or drug paraphernalia
- Content that facilitates money laundering, financial fraud, or tax evasion
B. Harmful and Abusive Content
- Content that is defamatory, libelous, or constitutes harassment, bullying, or threats of violence
- Content that promotes hate speech, discrimination, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
- Content that exploits, harms, or endangers minors in any way
- Content that promotes self-harm or suicide
C. Adult and Explicit Content
- Sexually explicit or pornographic content
- Content depicting or promoting sexual services
- Nudity or sexual content involving minors (zero tolerance; reported to law enforcement)
D. Regulated and Restricted Industries
- Gambling, betting, or lottery services (unless properly licensed and permitted by law)
- Tobacco, nicotine, vaping, or smoking-related products and content
- Alcohol promotion or sales (unless compliant with applicable laws and age restrictions)
- Firearms, weapons, ammunition, or explosives sales or promotion
- High-risk financial services, including payday loans, debt collection schemes, or unregistered securities offerings
- Pharmaceutical products or health claims that are not approved or verified by applicable regulatory bodies
E. Deceptive Content
- Content that is intentionally false, misleading, or designed to deceive
- Fake testimonials, fabricated reviews, or misleading endorsements
- Impersonation of any person, company, or entity
- Phishing pages, fake login screens, or social engineering content
- Misleading income claims, earnings guarantees, or “get rich quick” schemes
F. Infringing Content
- Content that infringes on copyrights, trademarks, patents, trade secrets, or other intellectual property rights
- Unauthorized distribution of copyrighted materials
- Counterfeit goods or services
2 Prohibited Conduct
You may not engage in any of the following conduct when using the Services:
A. Spam and Unsolicited Messaging
- Sending unsolicited bulk email, SMS, or other messages
- Sending messages to recipients who have not opted in or who have opted out
- Using purchased, rented, scraped, or harvested contact lists
- Failing to include required unsubscribe mechanisms in commercial messages
- Failing to honor opt-out or unsubscribe requests promptly
- Disguising the origin or true sender of messages
B. Security Violations
- Attempting to gain unauthorized access to the Services, other accounts, systems, or networks
- Probing, scanning, or testing the vulnerability of any system or network
- Distributing malware, viruses, ransomware, trojans, or other malicious code
- Interfering with or disrupting the Services, servers, or networks
- Conducting denial-of-service attacks or other attacks against the Services or related infrastructure
- Bypassing or circumventing security measures, access controls, authentication, or usage limits
C. Abusive Automation
- Using bots, scrapers, crawlers, or other automated means to access the Services without express written permission
- Exceeding rate limits or attempting to circumvent usage caps, throttling, or technical restrictions
- Scraping, harvesting, or extracting data from the Services
- Automated account creation or automated interactions that simulate human behavior
D. Fraud and Manipulation
- Engaging in fraudulent transactions, including using stolen payment methods or creating fake orders
- Self-referrals or artificially generating commissions, credits, or rewards
- Manipulating tracking, attribution, analytics, or reporting systems
- Creating multiple accounts to circumvent limits, bans, or restrictions
- Gaming promotions, contests, or incentive programs
E. Misrepresentation
- Impersonating Monarch, Scale, or any Monarch employee or representative
- Creating unofficial pages, domains, or social media accounts that suggest an official affiliation with Monarch
- Registering domains or social handles using Monarch trademarks or confusingly similar names
- Misrepresenting your identity, affiliation, or authorization to act on behalf of another person or entity
3 Messaging Compliance
If you use the Services to send email, SMS, or other electronic communications, you must comply with all applicable laws and regulations, including:
- TCPA (Telephone Consumer Protection Act): Obtain express written consent before sending marketing text messages; honor opt-out requests immediately.
- CAN-SPAM Act: Include a valid physical address and clear unsubscribe mechanism in commercial emails; honor opt-out requests within 10 business days.
- GDPR (General Data Protection Regulation): Where applicable, obtain consent for marketing communications and process personal data in accordance with EU/UK data protection law.
- CASL (Canada’s Anti-Spam Legislation): Where applicable, obtain express or implied consent before sending commercial electronic messages to Canadian recipients.
- Carrier and industry requirements: Comply with mobile carrier acceptable use policies, industry best practices, and applicable messaging guidelines.
You are solely responsible for the content, targeting, timing, consent, and legality of all messages you send through the Services.
4 AI Feature Usage
If you use AI-powered features within the Services, you agree to the following:
- You will review and verify all AI-generated content before publishing, sending, or relying on it.
- You will not use AI features to generate content that violates this AUP, including prohibited content categories listed in Section 1.
- You will not use AI features to generate misleading information, fake testimonials, or deceptive marketing materials.
- You will not attempt to manipulate, jailbreak, or bypass AI safety measures or content filters.
- You acknowledge that AI outputs may be inaccurate, incomplete, or biased, and that Monarch is not responsible for AI-generated content.
5 Resource Usage
You agree to use the Services in a manner that does not consume disproportionate resources or negatively impact other users. This includes:
- Not uploading excessively large files that exceed documented storage limits
- Not running processes or scripts that consume excessive bandwidth, processing power, or storage
- Not using the Services as a general-purpose file hosting, backup, or content distribution network
- Complying with any usage limits, quotas, or fair-use policies communicated within the Services or documentation
6 Reporting Violations
If you become aware of any content or conduct that violates this AUP, please report it to us at [email protected]. Include as much detail as possible, including URLs, screenshots, and a description of the violation. We will review all reports and take appropriate action.
7 Enforcement
Monarch may investigate suspected violations of this AUP. If we determine that a violation has occurred, we may take any or all of the following actions at our sole discretion:
- Issue a warning
- Remove or disable access to violating content
- Temporarily suspend your account or access to specific features
- Permanently terminate your account
- Report violations to law enforcement where required or appropriate
- Pursue legal remedies
Monarch reserves the right to act without prior notice where immediate action is necessary to protect the Services, our users, or third parties.
8 Changes to This Policy
We may update this Acceptable Use Policy from time to time. We will update the “Last Updated” date when changes are made. Continued use of the Services after changes become effective constitutes acceptance of the updated AUP.
